Elaine Agheepour's Story: A Fight Against Deception

Elaine Agheepour, former owner of ABC Check Cashing in California, found herself ensnared in NLS’s deceptive practices in 2010. Despite never signing any lease agreement or Personal Guarantee with NLS, she faced an unexpected lawsuit that led to severe financial repercussions. The ordeal included false derogatory credit reports, which compounded her challenges and ultimately forced the closure of her business.

Michele Norris's Experience: Battling Unjust Actions

Similarly, Michele Norris, former owner of M & J Hair Design in Texas, confronted fraudulent tactics by NLS in 2005. Despite complying with returning leased equipment and ceasing payments, Norris endured harassment and unjust legal actions due to falsified documents and baseless accusations from NLS.

Intervention by the NY Attorney General: Unveiling Systemic Fraud

In 2016, the New York Attorney General (NY AG) initiated a lawsuit against NLS and its affiliates, exposing extensive fraudulent activities. The court’s investigation revealed:

  • Negligence in overseeing Independent Service Organizations (ISOs)
  • Systematic fraud and exploitation of the NY City Civil Courts
  • Targeted harassment and deceptive practices aimed at personal guarantors

These findings culminated in the dissolution of NLS, dismissal of cases with prejudice, and substantial financial penalties totaling $680 million against NLS and nearly $10 million against Joseph Sussman and his law firm.

Jury Verdict: Upholding Justice

represented Agheepour and Norris before the jury. The verdict held the defendants accountable for multiple violations, including:

  • Racketeer Influenced and Corrupt Organizations (RICO) Act violations across all defendants
  • RICO conspiracy (excluding Cuccinata)
  • Violations of the Fair Credit Reporting Act (FCRA) and NY General Business Law (GBL) 349 against NLS, MBF Leasing, Joseph Sussman, and Joseph I Sussman PC

The awarded compensation totaled just under $3 million, covering damages, interest, and legal fees.
